Limited Warranty (Green-Rated Parts)
This Limited Warranty (the "Warranty") is provided by G & M INNOVATION GROUP INC d/b/a ITG Parts to the original purchaser of Parts that were rated GREEN by our Compatibility Check at the time of Order through itgparts.com (the "Site"). It is incorporated by reference into our Terms of Service and Refund Policy. Capitalized terms not defined here have the meanings given in the Terms of Service.
1. Limited Warranty Designation; Magnuson-Moss Compliance
This Warranty is a "limited warranty" within the meaning of the Magnuson-Moss Warranty Act (15 U.S.C. §§ 2301 et seq.). It is not a "full warranty" as that term is defined in 15 U.S.C. § 2304. The terms "limited," the disclaimers in Section 6, the sole-remedy provision in Section 4, and the non-transferability clause in Section 8 are intentional and consistent with limited-warranty designation under federal law.
The remedies, exclusions, and limitations stated below are the full extent of our warranty obligation. For statutory rights you may have under state law that cannot be waived (for example, certain non-waivable implied warranties in some states), see Section 9 (Statutory Rights).
2. Scope and Eligibility
This Warranty covers a single condition: the Part you received does not fit the appliance Model Number you provided at the time of Order, despite our system having rated the Part as GREEN-compatible with that Model Number.
This Warranty applies only when ALL of the following are true:
- The Compatibility Check Rating displayed at checkout was GREEN.
- The Model Number you provided at checkout matches the model plate currently affixed to your appliance.
- The claim is submitted within thirty (30) days of delivery.
- The Part is in its original condition and original packaging, suitable for return.
- The original purchase was made by the person filing the claim (this Warranty is non-transferable — see Section 8).
3. What This Warranty Does NOT Cover
This Warranty does NOT cover any of the following:
- Parts that were rated YELLOW or RED at checkout. You acknowledged those Ratings and chose to proceed; no fit guarantee was extended.
- Parts where the Model Number you provided does not match your appliance's actual model plate. Accurate model identification is your responsibility under Section 1 of the Terms of Service.
- Wear and tear, deterioration, or failure caused by normal use after installation.
- Damage caused by improper installation, modification, misuse, accident, or use outside the appliance manufacturer's instructions.
- Manufacturing defects in the Part itself — those are covered (if at all) by the original manufacturer's warranty, not by us. Contact the manufacturer directly for defect claims; we will provide the part-supplier contact on request.
- Labor costs, installation costs, removal costs, or repair costs.
- Consequential damages, including damage to the appliance or to other property arising from the Part's installation or use, loss of use of the appliance, food spoilage, water damage, or commercial losses.
- Acts of force majeure as defined in Section 14 of the Terms of Service.
4. Sole Remedy
If a valid Warranty claim is established, our sole obligation, and your exclusive remedy, is — at our discretion — either (a) a full refund of the amount paid for the Part, or (b) replacement with an equivalent Part. We are not obligated to provide installation services, on-site service, replacement of additional Parts, or compensation for any other expense. The choice between refund and replacement is ours; we will communicate the choice when we accept the claim.
5. How to File a Warranty Claim — Process and Timeline
Submission.
Email support@itgparts.com within thirty (30) days of delivery with: (a) your Order number; (b) the Model Number from your appliance's model plate, with a clear photograph of the plate; (c) photographs of the Part next to its intended installation location showing why it does not fit; and (d) a brief written description of the fit issue.
Response timeline.
- Acknowledgement: we aim to acknowledge receipt of a valid claim submission within two (2) business days.
- Initial evaluation: we will request any additional information needed and aim to either approve or decline the claim within five (5) business days of receiving all required materials.
- Disposition: if approved, we will issue an RMA number and return instructions (return shipping is at your expense, as set out in our Refund Policy) and, upon receipt of the returned Part in eligible condition, aim to complete the remedy (refund or replacement under Section 4) within ten (10) business days.
- Total maximum timeline: from claim submission to remedy disposition, the typical maximum is fifteen (15) to twenty (20) business days, contingent on your prompt response to requests for additional information.
Status updates.
We will email the address on your Account at each timeline checkpoint. If you do not receive an acknowledgement within two (2) business days, check your spam folder and contact support to confirm receipt.
6. Disclaimer of Other Warranties; State-Specific Carve-Out
EXCEPT FOR THE EXPRESS LIMITED WARRANTY ABOVE, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL OTHER EXPRESS WARRANTIES. BECAUSE WE PROVIDE THIS WRITTEN LIMITED WARRANTY ON GREEN-RATED PARTS, WE DO NOT DISCLAIM IMPLIED WARRANTIES ON THOSE PARTS; INSTEAD, AS PERMITTED BY THE MAGNUSON-MOSS WARRANTY ACT (15 U.S.C. § 2308(b)) AND APPLICABLE STATE LAW, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ON A GREEN-RATED PART IS LIMITED IN DURATION TO THE THIRTY (30) DAYS OF THIS WARRANTY, OR THE MINIMUM PERIOD REQUIRED BY APPLICABLE STATE LAW, WHICHEVER IS LONGER. WE DO NOT WARRANT THAT ANY GIVEN GREEN RATING WILL BE ACCURATE IN EVERY CASE; A GREEN RATING IS OUR BEST AI-ASSISTED ESTIMATE BASED ON THE INFORMATION YOU PROVIDED, NOT A GUARANTEE OF FIT.
State-specific carve-out.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES, OR LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS. IN THOSE STATES, OUR EXCLUSION OR LIMITATION APPLIES ONLY TO THE EXTENT PERMITTED BY LAW. WHERE AN IMPLIED WARRANTY CANNOT BE DISCLAIMED, IT IS LIMITED IN DURATION TO THE THIRTY (30) DAYS OF THIS WARRANTY OR THE MINIMUM PERIOD REQUIRED BY APPLICABLE STATE LAW, WHICHEVER IS LONGER. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
7. Limitation of Damages
OUR AGGREGATE LIABILITY UNDER THIS WARRANTY IS LIMITED TO THE AMOUNT YOU PAID FOR THE PART AT ISSUE. IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF USE OF THE APPLIANCE, DAMAGE TO OTHER PROPERTY, FOOD SPOILAGE, WATER DAMAGE, COMMERCIAL LOSSES, OR LABOR COSTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES; IN THOSE STATES, OUR LIMITATIONS APPLY ONLY TO THE EXTENT PERMITTED BY LAW.
Nothing in this Warranty excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for any other liability that cannot be excluded or limited under applicable law.
8. Non-Transferable
This Warranty is non-transferable and applies only to the original purchaser as identified by the Order record. It does not extend to a buyer in a private resale, a recipient of a gift, or any subsequent owner of the Part. If you wish to gift a Part that includes this Warranty, contact us before purchase to discuss alternatives.
9. Statutory Rights
This Warranty grants you specific legal rights. You may also have other rights that vary by state or jurisdiction. Nothing in this Warranty limits non-waivable consumer protection rights you have under applicable law. The federal Magnuson-Moss Warranty Act (15 U.S.C. §§ 2301 et seq.) and applicable state implied-warranty statutes apply to this Warranty alongside its express terms.
